Bac Giang accompanies businesses in implementing housing, residential area projects
Le Tuan Anh, a representative of Fiji Bac Giang Development Joint Stock Company, stated that according to the Housing Law 2014 on identifying beneficiaries of social housing policy and the provincial People's Committee's decision on the plan to invest in building social housing for workers in Noi Hoang commune (Yen Dung district), this work was built to meet the housing needs of workers working in industrial zones and clusters, but the unit is still facing some problems.

He asked whether the investor can rent houses for foreign workers and officials working in industrial zones or clusters or the investor can lease them to foreign-invested enterprises to make dormitories for workers. Anh proposed relevant agencies guide the organization of the condominium conference, the establishment and recognition of the condominium management board, the hiring of a management unit in accordance with the law, and establishment of an enterprise under business cooperation contract (BCC).
Fiji Bac Giang Development Joint Stock Company and Vinaco Construction Investment Joint Stock Company signed a joint venture contract to implement the project building social housing for workers in Noi Hoang commune (Yen Dung district) on a total area of more than 5.3 hectares. The first blocks are expected to be put into operation in the second quarter of 2021.

Nguyen Anh Tuan, Project Manager of Foxconn Vietnam, said that according to Decree 100 issued in 2015, investors of social housing projects without using the budget funds are exempt from land use fees and land rents for land areas allocated or leased by the State, including land lots for construction of commercial and business projects approved by competent agencies within the scope of social housing construction projects.
However, the procedures for exemption of land rents and land use fees are still cumbersome, causing difficulties for businesses. Specifically, the dossier is required to be submitted within 20 days from the date of issuance of the land allocation decision of a competent state agency in accordance with the land law.
The land user must also submit a list of employees or cooperatives to be given houses certified by a competent state agency in accordance with the housing law. This is an unreasonable provision, because within 20 days after the decision on land allocation is issued, the project is yet to be implemented and cannot be opened for sale, so there is no employee list available.
After listening opinions by a number of real estate businesses, Chairman of the provincial Real Estate Association Lai Thanh Son held that many State regulations were in effect, but it requires the rational application of authorities to both create conditions for businesses, and ensure compliance with regulations.
A representative from the provincial Tax Department informed that the agency proposed the Ministry of Finance land use fee exemption or reduction for investors who carry out social housing projects without using the budget capital.
Regarding the establishment of enterprises under the BCC projects, Nguyen Van Huong, Deputy Director of the provincial Department of Planning and Investment, said that according to regulations, currently the BCC projects are not allowed to establish enterprises. The department will take up this recommendation to propose measures to address it.
Dao Cong Hung, Deputy Director of the Department of Construction, emphasized that his agency has always paid attention to the management of granting construction permits, but the regulations on civil work in projects are based on facts and laws.
Bac Giang is one of the leading localities in terms of economic growth, so urban development should be expanded towards modernity and sustainability. To do this, the civil work is necessary for the early formation of urban areas, towards a more transparent and realistic real estate market, and a synchronous and modern infrastructure system.

Regarding some questions related to the beneficiaries of social housing, Hung stated that foreigners are not allowed to rent social housing, but only 20 percent of commercial housing.
According to regulations, only Vietnamese workers are entitled to social housing and worker housing. Foreigners are only allowed to rent but not buy social housing, with the police’s approval and national security and social order and safety ensured. Enterprises are also not allowed to sublease social housing to their workers.
However, the department is studying and reviewing this content to report to higher-level agencies because beneficiaries must be workers working in industrial zones and clusters.
